1.1. These General Terms define the rights, obligations, and conditions for using the information service and the services it provides, as established by BRIEFING E-SERVISI d.o.o., Ulica Andrije Hebranga 21, Zagreb, OIB: 06785674428 (hereinafter: Briefing e-servisi d.o.o.).
2.1. Through its online service, Briefing e-servisi d.o.o. provides the User with information on published public tenders and procurement procedures and forwards them via email, selected in accordance with the agreement with the User. These information are also delivered to the User’s database, which the User accesses using the provided login credentials. The User bears full responsibility and risk for any further sharing or disclosure of the data and information delivered to their database.
3.1. The contractual relationship between Briefing e-servisi d.o.o. and the User is established through the User’s registration on the website www.briefing-nadmetanja.hr
and/or by placing an order via a completed form, which is confirmed by Briefing e-servisi d.o.o. via email. By entering into the contract in this manner, the User accepts these General Terms as an integral part of the agreement.
3.2. The User is required to provide accurate information during registration and must promptly notify any changes to the data provided during registration and/or login. Briefing e-servisi d.o.o. reserves the right to revoke access to the service (user credentials) at any time with immediate effect and without explanation, particularly if the User provides inaccurate information during registration or engages in any conduct not undertaken in good faith.
4.1. The contractual relationship is concluded for a period of one, three, six, or twelve months, depending on the User’s choice. After expiry, it may be extended with written consent or upon the User’s request.
4.2. If the User fails to comply with these General Terms or does not pay, or is late with payment for the use of the online service, Briefing e-servisi d.o.o. reserves the right to suspend access to the service and/or terminate the contract with immediate effect without prior notice. Termination shall be made in writing or via email. Refusal to accept delivery does not constitute termination of the contract.
4.3. Briefing e-servisi d.o.o. is also entitled to terminate the contract with immediate effect and without prior notice if access to data on published public tenders and procurement procedures becomes unavailable without limitation.
4.4. The provision of free services, in particular the 15-day free trial, may be discontinued at any time without prior notice. The User shall not be entitled to any rights on this basis.
5.1. Payment for the use of services provided by the information service www.briefing-nadmetanja.hr
is made based on a pro forma invoice. All offers are non-binding, and all deliveries are payable immediately upon receipt of the invoice, without discounts or deductions. All stated prices are subject to applicable value-added tax (VAT).
5.2. The payment provision set out in section 5.1 of these General Terms does not apply to the 15-day free trial of the service/subscription.
6.1. Briefing e-servisi d.o.o. shall not be liable for:
– the accuracy of data stated in the source of a tender or procurement notice;
– the correctness or completeness of the data, nor for cases where the information service and its content do not meet the User’s requirements or expectations;
– damages resulting from delayed or failed data delivery, or from the unavailability of the online service due to maintenance or operational issues;
– the accuracy of data obtained from third-party sources or errors in data transmission from such sources;
– damages caused by force majeure or by third parties.
6.2. Briefing e-servisi d.o.o. shall be liable for damages caused by intentional misconduct or gross negligence in fulfilling contractual obligations.
6.3. In any case, Briefing e-servisi d.o.o. shall not be liable for damages exceeding the amount of one annual fee for the use of the information service.
7.1. The User may use data from the information service solely for their own business purposes. Any further commercial use of the data by the User is prohibited. The User is not permitted to publish, reproduce, modify, distribute, reprint, or otherwise use the data, particularly for the creation of databases or for sharing with third parties, without the prior written consent of Briefing e-servisi d.o.o.
7.2. Briefing e-servisi d.o.o. reserves the right at any time to monitor the use and manner of use of the data and to deny the User access to their data in case of a breach of obligations under section 7.1 of these General Terms, as well as any other contractual obligations, if necessary and without prior notice. In cases of misuse, the User is not entitled to a refund of the subscription fee.
8.1. The User undertakes not to misuse the subscription access to the service www.briefing-nadmetanja.hr.
8.2. The User is obliged to keep the assigned access credentials (login details) confidential and not to grant access to third parties. In the event of theft, the User must notify Briefing e-servisi d.o.o. without delay. The User is responsible for any misuse of access credentials under their control, as well as for any damage resulting from misuse or loss of such credentials.
8.3. The User undertakes not to use any tools and/or software when accessing the service www.briefing-nadmetanja.hr
that may negatively affect the functioning of the information service. The service is intended to be used only within the scope of normal business operations and as agreed.
8.4. The User is solely responsible for ensuring, maintaining, and organizing the technical requirements necessary to access the service www.briefing-nadmetanja.hr
and to receive email communications, including providing a valid email address and ensuring sufficient mailbox capacity.
8.5. The User is responsible for any disruptions caused by improper or unprofessional use of the database.
9.1. The use of the User’s personal data is governed by the Privacy Policy of Briefing e-servisi d.o.o., available on the website www.briefing-nadmetanja.hr.
10.1. These General Terms shall enter into force within 3 (three) days of their publication on the website of Briefing e-servisi d.o.o. and shall apply to all valid contracts. Any contractual provisions deviating from these General Terms shall have no effect.
10.2. Briefing e-servisi d.o.o. reserves the right to amend and supplement these General Terms. Such amendments shall enter into force within 3 (three) days of their publication on the company’s website. It shall be deemed that the User has accepted the amendments if Briefing e-servisi d.o.o. does not receive a notification from the User within 7 (seven) days of their entry into force stating that they do not accept the changes. Amendments that are solely in favor of the User may be applied immediately, as well as those resulting from changes in legal regulations or the adoption of new laws.
10.3. If the User does not accept the amendments, Briefing e-servisi d.o.o. has the right to terminate the contract with immediate effect and without prior notice, or to terminate the contract and offer the User a new agreement under the amended terms.
10.4. The provision of Article 10.3 shall apply accordingly to the application of these General Terms to contractual relationships referred to in Article 10.1.
10.5. Any amendments to the General Terms, pricing, or payment conditions shall be communicated to the User in writing, via email, or online.
10.6. Any amendments to the contract, as well as any ancillary or special agreements, must be confirmed in writing by Briefing e-servisi d.o.o. in order to be valid and binding.
11.1. The place of performance of the contract shall be the registered seat of Briefing e-servisi d.o.o.
11.2. In the event of a dispute arising from the contractual relationship or rights deriving from it, the competent court in Zagreb shall have exclusive jurisdiction, and Croatian law shall apply.
